By booking your shoot and paying your booking confirmation fee (50%) of full amount, the client agrees to the Photo session terms and conditions.
PHOTO SHOOT AGREEMENT TERMS
Client is guaranteed the agreed upon time for the duration of the package chosen. The photographs will then be edited (allow 3-5 working days). It is Trey imaGes’s enpolicy to never release any unedited pictures in any form to anybody.
CANCELLATION/POSTPONEMENT
(where applicable) Client understands that by entering into this agreement, Trey imaGes is foregoing other photographic jobs. In the event of a cancellation or postponement of the photographic session/agreement by client, the amounts paid are non refundable. Deposits are transferable if a date change is necessary. Twenty-four hours’ notice of postponements or……
WEATHER (WHERE APPLICABLE)
If it is not possible for shoot to take place on a scheduled day due to weather, Trey imaGes and client will reschedule on an agreed date at the earliest date possible with no additional charge.
COOPERATION | NO SHOWS
Trey imaGes is not responsible if the client and/or key individual fail to cooperate or appear during photo shoots, or for missed images due to details not revealed to Trey imaGes. If the client and/or key individuals fail to arrive to a scheduled photo shoot the full amount is non-refundable. The session can be rescheduled at the original photo shoot.
RESHOOTS – CAMERA FAILURE OR EXPOSURE PROBLEMS
In the unlikely event that the finished product from a photo shoot is unusable due to technical problems, (camera failure or exposure problems), Trey imaGes will re-shoot at no additional charge.
COPYRIGHT
All images are copyrighted to and remain property of Trey imaGes.
CLIENT’S USAGE
Client is obtaining digital for personal use only, and shall not sell said digitals. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Trey imaGes. A credit line that reads “Trey imaGes” and our contact details in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.
MODEL RELEASE
Client grants to Trey imaGes and their legal representative and assigns, the irrevocable and unrestricted right to use and publish photographs of the client, client’s child or children, or in which the client may be included for editorial, trade, advertising and other related purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same.
Client hereby releases Trey imaGes and their legal representative and assigns from all claims and liability relating to said photographs.
EXHIBITION
Client grants Trey imaGes permission to display selected images resulting from this assignment as an example of Trey imaGes’s work and for entrance into photographic competitions and releases all claims to profits that may arise from use of
LIMIT OF LIABILITY
We take the utmost care with respect to exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Trey imaGes’s control, Trey imaGes liability is limited to the refund of all payments received, or a re-shoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the initial total amount, based on the percentage of the originals lost or damaged. In the unlikely event that a photographer is injured or becomes too ill to attend the photo shoot, Trey imaGes shall make every effort to reschedule to the earliest possible date. If this situation should occur, and the photo shoot must take place on the rescheduled date, Trey imaGes will make every effort to secure a replacement photographer. If this situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received.
CHANGES TO THIS AGREEMENT
There may be additional charges if changes are made to this agreement. Client may increase the period of Trey imaGes’s service on the shoot date, provided Trey imaGes is available during the time requested. Added expenses resulting from such change, including additional service cost, digital capture costs, and change-related fees will be added on to the final balance and will be paid in full by client prior to delivery of the photos. Client may not decrease the period of Trey imaGes’s service on the photo date. If the period of Trey imaGes’s services is cut short by reason of fire, casualty, death, act of God or other cause beyond the control of the parties, Trey imaGes shall still receive the total fees. These terms are not exhaustive and Trey imaGes retains right to change without prior notice or consent at its own discretion.
